Terms of Service

By using Health OS, you agree to these Terms. If you disagree — please do not create an account or use the Service.

1. Acceptance of Terms

By creating an account via Google OAuth, or otherwise using the Health OS website and application (the “Service”), you confirm that you have read and accept these Terms of Service together with our Privacy Policy.

If you act on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf. The current version of the Service is intended for personal use only.

2. Service description

Health OS is a personal self-tracking and N-of-1 experimentation platform: it imports health metrics from third-party trackers (Oura, RescueTime, etc.), collects manual self-reports, runs cognitive tests, structures self-observation protocols, and visualizes results.

The Service is provided “AS IS” and may change without prior notice.

3. Eligibility

  • You must be at least 18 years old and legally capable of entering into a contract.
  • You must comply with the laws of the country from which you use the Service.
  • The Service is not intended for children under 16 (GDPR Art. 8).

4. Account

  • Login is available only via Google OAuth SSO. Local passwords are not stored.
  • You are responsible for securing access to your Google account.
  • One person — one account. Transferring the account to third parties is prohibited.

5. Usage rules

You must not:

  • Use the Service for commercial resale, SaaS repackaging, or providing services to third parties.
  • Attempt to bypass access restrictions, reverse-engineer the client or server, or scrape the site beyond reasonable use.
  • Upload data that does not belong to you, or data about other people without their consent.
  • Use the Service in violation of EU law or the laws of your country of residence.

6. Not medical advice ⚠️

Health OS is not a medical device, does not diagnose or treat, and does not replace professional medical advice.

  • Health metrics (Oura, HRV, sleep, temperature, cognitive tests) and any aggregates or interpretations in the Service are informational and educational only.
  • The Service is not intended for the diagnosis, prevention, or treatment of disease.
  • Before changing your lifestyle, medication, supplements, physical activity, or sleep routine based on data from the Service — consult a qualified healthcare professional.
  • In case of acute symptoms (chest pain, shortness of breath, suicidal thoughts, etc.) — contact emergency services or a relevant specialist immediately. Do not rely on the Service.

The operator is not liable for medical decisions made by the user based on data displayed in the Service.

7. User content and license

  • You retain all rights to the health data, self-reports, notes, and other content you upload to the Service (“User Content”).
  • To operate the Service, you grant the operator a non-exclusive, royalty-free, limited license to store, process, and display your User Content — solely for the purpose of providing the Service to you personally.
  • We do not sell User Content, do not share it with third parties for marketing, and do not use it to train third-party ML models.
  • Anonymized and aggregated metrics (e.g., total number of users) may be used to improve the Service and for public statistics.

8. Third-party integrations

The Service may connect to third-party APIs (Oura, RescueTime, Google Calendar, YouTube, etc.). Use of those services is governed by their own terms and privacy policies. The operator is not responsible for the availability, correctness of data, or policy changes of third-party providers.

9. Intellectual property

All rights to the code, design, texts, trademarks, and other elements of the Service (other than User Content) belong to the operator or its licensors. No rights are transferred to you by your use of the Service, other than the limited license to use the Service as intended.

10. Warranty disclaimer

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of data, or uninterrupted operation.

The operator does not warrant that:

  • the Service will operate without interruptions or errors;
  • third-party integration data will always be available or correct;
  • the results of any analysis or protocol will produce the claimed effect.

To the extent permitted by applicable EU consumer-protection law, these limitations do not affect the mandatory statutory rights of consumers.

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • The operator is not liable for indirect, incidental, punitive, or special damages (loss of profit, loss of data, harm to health caused by self-treatment, etc.).
  • The operator’s aggregate liability to the user in any case is limited to the amount paid by the user for the Service over the last 12 months; for a free Service — 0 EUR.
  • Nothing in these Terms excludes liability for intent, gross negligence, or harm to life/health where such liability cannot be limited under applicable law.

12. Indemnification

You agree to indemnify the operator for reasonable damages and expenses (including legal fees) arising from your violation of these Terms, applicable law, or third-party rights.

13. Termination

  • You may request account deletion at any time by emailing [email protected] from your account email. After confirmation your data is cascade-deleted within 30 days (excluding legally required backups).
  • The operator may suspend or terminate your access for violations of these Terms, attempts to attack the Service, or as required by law, with reasonable notice unless that would create a security risk.
  • After termination, sections 7 (User Content), 9 (IP), and 10–12 (liability) survive.

14. Changes to Terms

We may update these Terms. Material changes will be announced at least 30 days before they take effect — on this page and/or via the email provided at registration. By continuing to use the Service after the effective date you accept the updated Terms. If you disagree — request account deletion before that date.

15. Governing law and jurisdiction

  • Governing law: the law of the Republic of Lithuania and directly applicable EU norms (including GDPR).
  • Disputes are subject to the competent courts at the operator’s location (Vilnius, Lithuania), without prejudice to the mandatory rights of EU consumers to bring proceedings in the courts of their residence.
  • Before court proceedings, the parties will make good-faith efforts to resolve the dispute by correspondence at the address below.
